  1. Confirmed as incorrect pricing

    Here's an email :
We are experiencing technical problems with a the feed from one of our warehouses.

The stock & price that is indicated is incorrect.

  2. With price now at just below R12 000, this would have been a great deal for just under R1000... damn

    1. Google search the product and the value at different online stores is $600 - $680. Clearly they have a massive mark up... almost 100% profit. Or perhaps that's just the customs duty and import tax that us South Africa have to suffer...

  3. I went as far as buying the laptop and it failed after payment.
Now it's on the site for R9k.
    Dammit!!!

  4. Flip?!! is it worth R12,000? managed to get 1 : )

  5. I bought 4 of the monitors. Now I see that the price has changed. And I also see that they are fully covered for pricing errors in their T&C's. Oh well ...

  6. I wish I got the laptop. Placed the order for the screen but never see the laptop part. lol. As far as I know, they have to give the people that ordered it and paid for it even if it is a incorrect price. Lets hope that is the case.

  7. For those who got through the order process, did you recieve and type of confirmation from Firstshop and does it reflect on your order list?

  8. Yes. I bought 2 TVs and my invoice says R23997.60 Less Payment R23997.60 Total Due R0.00. And I still had to call FNB to sort out some !@$@# with VISA first.

  9. I placed the order and it got the receipt for it. They have not confirmed payment but it was made prior to them fixing the incorrect price. As far as I know, it is false advertising and they cannot just refund you. You can take them to court and they will lose, have to pay for your lawyers and give the item. They cannot cover themselves just with that clause in T&C's. Incorrect advertising is illegal and they have to hold it to that price for orders placed and paid for.

    1. I hope you are correct. I mean, how can we possibly win? Get an expensive lawyer that they cannot afford? then they will have to pay for said lawyer? I have all the proof printed.

  10. I had to cancel a deal for which I already paid shipping privately... this is such BS.

  11. Why private shipping? I thought all items come with free shipping. I also have proof of receipt of the order item, price and everything. Also the above on this site shows the original items and price. That should be enough to take them to court if they wish to not honour items bought and paid for already. If they chose to not honour it, I am going to call a few companies and explain the issue and what I have, and see whether they willing to take them to court and only if we win the case, they will charge the fee. Also, will make them claim all their fees within the court case so I am not out of money from my pocket. That seems to be the only option right now as most people can't afford a case like this.

    1. What I meant was that I was in the process of buying elsewhere through a friend overseas and when I saw this deal I cancelled the first one. But what you just said sounds too good to be true. I know large brands & retailers would rather pay big bucks to shut a consumer up rather than have their name dirtied.

  12. As far as I know, I have paid for the products as advertised on their site, therefore they have to supply :)

Consumer Protection Act, 2008 (Act No. 68 of 2008)
Chapter 2 : Fundamental Consumer Rights

Part E : Right to fair and responsible marketing

    30. Bait marketing

1)A supplier must not advertise any particular goods or services as being available at a specified price in a manner that may result in consumers being misled or deceived in any respect relating to the actual availability of those goods or services from that supplier, at that advertised price.

2)If a supplier advertises particular goods or services as being available at a specified price, and the advertisement expressly states a limitation in respect of the availability of those goods or services from that supplier at that price, the supplier must make those goods or services available at that price, to the extent of the expressed limits.

3)It is a defence to an alleged failure to comply with subsection (1) or (2) if—
a)the supplier offered to supply or procure another person to supply a consumer with the same or equivalent goods or services of the kind advertised within a reasonable time, in a reasonable quantity, and at the advertised price; and
    b)the consumer—
    i)unreasonably refused that offer; or
ii)accepted the offer, and the supplier has supplied or procured another person to supply the goods or services so offered and accepted.

      31. Negative option marketing

      1)A supplier must not—
      a)promote any goods or services;
b)offer to enter into or modify an agreement for the supply of any goods or services; or
c)induce a person to accept any goods or services or to enter into or modify such an agreement,
on the basis that the goods or services are to be supplied, or the agreement or modification will automatically come into existence, unless the consumer declines such offer or inducement.

2)An agreement purportedly entered into as a result of an offer or inducement contemplated in subsection (1) is void.

    2. I don't think these Act's apply as there was no marketing or advertisement directly from First Shop for these products.

  13. So now the real question is whether they will honour the deals, or take a chance for every client to sue them. Think they might be force to honour the deal as 10 court cases will cost more then honouring all the items. Wonder if a list of all the specials available and how many were sold is available. Company is going to run a few million loss from this...

    ReplyDelete
  14. The price on the website is misleading and counts as the advertised price as far as I know. If the item is on their website, then it is being advertised there.

    ReplyDelete
  15. Unless someone has direct marketing from them for these products, looks like we're all going to have to settle for a refund.

    ReplyDelete
  16. The items where not listed under their specials nor did FirstShop advertise them in any way, a quick search on there website revealed more than 11000 products it is obvious that mistakes will be made and accidents will happen.

unfortunately we don't have a foot to stand on and besides it doesn't take a Genius to figure that there is a pricing issue everyone who ordered new they where taking a chance.

  17. Paid an attorney: http://www.justanswer.com/south-africa-law/8atii-purchased-products-online-store-south-africa.html

Bottom line is: "If you however confront the supplier with the above info, they might just give you the products to get the whole thing behind them but I must caution you not to threaten them to deliver or else as it could be seen as extortion and you might get into trouble for that."

So there we have it... personally I am going to wait till I get some sort of email from them (which I have yet to receive regarding purchase or delivery). If I were them I would at least reply and be courteous... Delivery will cost them a couple of million... and I wouldn't want to be them. Bait marketing = they pay up and go to prison.

  18. I just got an email saying they cancelled my orders. Anyone else in this boat?

    ReplyDelete
  19. Yes, got a cancellation email asking for my bank account to refund the cash,

    ReplyDelete
  20. Also got an email, people make mistakes and they have offered a 10% discount on my next purchase, I don't want someone to get fired over this or the company to lose millions, so I have filled out the refund form.

  21. I knew it was too good too be true, lol. I'll have my refund now, thank you.

  22. I did not get an email and order is currently still on pending. Weird
